Recent Defense Verdict - Eric Anderson finished a trial in federal court last month where a jury returned a verdict in favor of Mr. Anderson’s client. The case involved a claim against Mr. Anderson’s client, a company that manufactures sheet metal roofing and siding materials. The plaintiff was injured by a piece of the material which he was handling. The plaintiff sustained a severe laceration of his arm severing multiple tendons. The plaintiff claimed that the defendant provided a defective product, it was improperly packaged, improperly shipped and was not secured in a manner so as to avoid the accident described by the plaintiff. In defense, a complete history of the company and a detailed description of the manufacturing process supplemented with photographs, actual materials and a video was sufficient to convince the jury that there was nothing improper in the manufacturing, packaging, shipping or storing of the material prior to the plaintiff’s injury. No post trial motions were filed following the verdict entered in the United States District Court for the Western District of Pennsylvania.
